Madison County Circuit Judge Dennis Ruth is set to hear post-trial motions Friday in a man's suit against CSX Transportation that ended in a victory for the company last year at trial.
The case file indicates that plaintiff Russell "Dewey" Aper still has a move for a new trial pending in the case.
Aper claims that CSX failed to provide him with a safe work environment or help and that the failure led to him re-injuring his back a month after a previous injury.
The trial took place last October.
Aper's attorney, Amy Collignon Gunn, sought damages in excess of $500,000 for her client.
The jury found for CSX.
Aper then moved for a new trial.
That motion's hearing has been pushed back several times, most recently last month.
