Jogger claiming injuries from boys soccer team settles with Granite City

A woman who claimed a boys' soccer team injured her during a jog in 2004 has settled a lawsuit against Granite City Community Unit School District #9 and the city's park district.

The case had been set to open at trial before Madison County Chief Judge Ann Callis on Monday.

Details of the settlement reached between plaintiff Opal Boyett and defendants, including the Granite City Park District, are not yet available.

Boyett sought damages of at least $50,000 and costs.

According to her third amended complaint, Boyett was walking along a path in Wilson Park in Granite City on July 2, 2004.

At the same time, members of a boys' school soccer team were also running on the path.

Boyett claims that the boys were unsupervised and that after failing to yield the right of way to her, collided with her causing her to injure her left elbow, head, heart and body as a whole.

The suit had named Derrick Wente, Kyle McGovern, Daniel Fowler, Kevin Staples, Ryan Roberts, Andrew Briner, Aaron Streid, Nicholas Costillo, Alexander Mossman, Brent Lyons, Dennis Bistro, John Ritchie, Bradley Peach, Erik Klove, Ian Nespit and Barry Grote as defendants.

Grote coached the boys, according to the complaint.

The remaining defendants were members of the soccer team.

A whittled down fourth amended complaint filed in October 2006 included only the school district, Grote and Wente as defendants.

The park district was dismissed from the suit in April 2006.

The settlement, according to the case docket sheet was announced via the plaintiff's counsel's office.

A status conference is set May 25 at 9 a.m. before Callis.

Bob Perica represents Boyett. Timothy Hulla had previously represented her.

Donald Ohl represents the school district.

The other defendants in the suit do not have representation listed.

The case is Madison case number 05-L-618.
