A Fairview Heights woman has filed suit against Home Depot, where she alleges she fell over a hose, sustaining injuries to her left arm, wrist, elbow, left knee, hip and body.
Carolyn Taylor claims she was shopping at the Home Depot located in O'Fallon on Oct. 23 when she tripped on a hose in the garden center that had been placed across the lot to water flowers.
In addition to her severe and disabling injuries, Taylor sustained great pain and mental anguish and lost wages because of her inability to pursue her occupation, according to the complaint filed Feb. 22 in St. Clair County Circuit Court. She also incurred medical costs, the suit states.
Home Depot negligently failed to mark a dark hose, failed to maintain its premises in a safe condition, failed to inspect the outdoor garden where lighting was obstructed by trees, failed to warn customers of the presence of a hose in an area in which lighting was obstructed by a tree and failed to provide proper lighting, the complaint says.
In her complaint, Taylor is seeking a judgment of more than $50,000, plus costs.
