No action has taken place in more than two years in a Madison County class action suit filed over faxed advertisements.
The last filings in the suit filed by plaintiff Locklear Electric of Wood River against Taylorville Chiropractic Clinic filed occurred in June 2009.
Locklear sued the clinic over violations of federal law governing faxed ads. Locklear claims the unwanted faxes cost it and other potential class members money in the form of ink and paper.
The suit is one of a number of faxed ad class actions Locklear has filed in both Madison and St. Clair counties.
Locklear won a default judgment in a 2008 faxed ad suit it filed against Christopher Parks and American Business Lending in January.
Robert Sprague represents Locklear in the 2009 case.
Lanny Darr represents the company in the 2008 suit where Locklear won the default judgment.
No attorneys are listed for the defendants in either suit.
Madison County Circuit Judge Dennis Ruth heads the Taylorville case.
