Frank Scott Parkway accident causes injuries

After an intoxicated driver rear-ended him, an Illinois man sustained serious injuries, according to a recently filed lawsuit.

Nadim A. Kazi filed a lawsuit Feb. 16 in St. Clair County Circuit Court against Benjamin R. McGuigan.

Kazi claims he drove east on Frank Scott Parkway in St. Clair County on Feb. 21 when McGuigan, who drove in the same direction, "was caused to violently overtake and collide with the rear end of Plaintiff's motor vehicle."

In addition to his injuries, Kazi incurred medical costs, experienced pain and suffering and lost his normal life, according to the complaint. He also sustained disability, suffered an increased risk of future harm and lost wages, the suit states.

Kazi blames McGuigan for causing the collision, saying he negligently drove too fast, failed to yield the right-of-way, failed to reduce his speed, failed to keep a proper lookout, failed to obey traffic signals and failed to drive safely. In addition, McGuigan negligently failed to avoid the collision, failed to keep a safe distance from the vehicle in front of him, failed to safely bring his vehicle to a stop and drove while intoxicated, the complaint says.

In his complaint, Kazi seeks compensatory damages of more than $50,000, plus pre-judgment interest, attorney's fees, costs and other relief the court deems just.

Reiad M. Khouri of Khouri Law Firm in St. Louis will be representing him.

St. Clair County Circuit Court case number: 11-L-79.
