Woman injured at Fairview Heights bar sues man who hit her

A St. Clair County woman sustained a broken wrist after a fellow bar patron assaulted her in a parking lot, according to recently filed court documents.

Taffy R. Caradonna-Stewart filed a lawsuit Feb. 15 in St. Clair County Circuit Court against Arthur M. Toms.

Caradonna-Stewart claims she witnessed Toms fighting with two other males as she patronized Baxter's in Fairview Heights on Feb. 27, 2010. The fight started inside the bar, then moved outside, according to the complaint.

"That plaintiff attempted to leave the bar, at which time the defendant struck her causing her to fall into a parked car and bounce off said car striking the pavement," the suit states.

Because of the incident, Caradonna-Stewart became sick, sore, lame, disordered and disabled and experienced pain and suffering, the complaint says. In addition, she claims she sustained a broken left wrist and a fractured collarbone.

Caradonna-Stewart blames Toms for causing her injuries, saying he failed to maintain a safe environment and failed to exercise reasonable care.

In her two-count complaint, Caradonna-Stewart is seeking a judgment of more than $100,000, plus unspecified punitive damages and costs.

Stephen R. Clark of Courtney, Clark and Associates in Belleville will be representing her.

St. Clair County Circuit Court case number: 11-L-73.
