The mother of a minor boy has filed suit against the village of New Baden after she says her son sustained second- and third-degree burns when he fell into an open burn pit.
Dawn Neely claims her son, Hunter Neely, was playing with a friend near a park in New Baden on Aug. 27 when he fell into the open burn pit and sustained burns to the bottoms and sides of his feet.
"No flames were visible at the time and no fence or warning signs existed at or near the burn pit," the suit states.
According to the complaint filed Feb. 15 in St. Clair County Circuit Court, Hunter Neely suffered severe injury and pain because of his fall, lost his enjoyment of life and experienced pain and suffering.
The village of New Baden negligently failed to warn Hunter Neely of the danger, failed to fence in the hazardous condition and violated city ordinances by having a burn pit, the complaint says.
In her two-count complaint, Dawn Neely is seeking a judgment of more than $100,000, plus costs.
