A Madison County woman has filed suit against the driver who she claims swerved into her vehicle.
Faith Fassero claims she was driving her 2003 Kia Rio west on Homer Adams Parkway on Aug. 29, 2005, when defendant Charles Hardester, who was driving in the same direction, swerved into Fassero's lane, causing the collision.
Because of the accident, Fassero suffered pain, discomfort and mental anguish and lost her normal life, according to the complaint filed Feb. 24 in Madison County Circuit Court. In addition, Fassero lost earnings and benefits, experienced a diminished earning capacity, incurred medical and hospital costs and was restricted in her usual activities, the suit states.
Hardester negligently failed to keep a proper lookout, failed to see things that were visible, failed to keep his vehicle under proper control, failed to use every precaution to avoid a collision, failed to drive at a safe speed and entered a traffic lane occupied by another vehicle, the complaint says.
In her complaint, Fassero is seeking a judgment of more than $50,000, plus costs.
