A St. Clair County woman claims she lost her mobile home when her lending company failed to pay real estate taxes on her property.
Pamela D. Hall formerly known as Pamela D. Farkosh claims she purchased a Fortune Homes mobile trailer, which she financed through defendant Green Tree Servicing.
By July 2004, Hall was unable to pay the real estate taxes on her mobile home and contacted Green Tree Servicing to inform it of her dilemma, according to the complaint filed Feb. 9 in St. Clair County Circuit Court. Green Tree promised to pay the real estate and mobile home taxes on Hall's property, the suit states.
However, Green Tree failed to do so in 2005, causing the taxes to be sold and Hall to be evicted from her property, the complaint says.
"That as a result of Defendant's negligence, Plaintiff has incurred damages including, without limitation, the loss of the value of the property, the cost of procuring other housing for Plaintiff and her children, the loss of personal property which she was unable to remove from the property and was subsequently stolen, and the emotional distress caused by losing her home," the suit states.
In her three-count complaint, Hall is seeking a judgment of more than $100,000, plus attorney's fees, costs and other relief the court deems just.
