New Athens accident is subject of suit

A St. Clair woman is suing the driver and owner of the car she says crashed into her in New Athens.

Terry Theis filed the lawsuit against Charles R. Ellett and Yvonne G. Casey on Dec. 8 in St. Clair County Circuit Court.

According to the complaint, in October 2010, Theis was driving her car east on Route 13 in New Athens. She says Ellett was driving south on Highway Highway 156 near the intersection of Route 13. Theis claims Ellett failed to obey the stop sign and crashed into the front.

Theis says she injured her neck and back in the collision. Theis is suing Ellett for negligence, claiming he should have been able to avoid the crash.

Casey is named as a defendant for loaning the car to Ellett. Theis contends Casey should have known Ellett was a reckless driver.

Theis is asking for more than $100,000 in damages for medical costs, lost wages and court fees.

Attorneys Thomas C. Rich and Kristina D. Cooksey of Fairview Heights are representing Theis.
