A woman's suit over the deaths of her husband and infant son two years ago has settled.
The case brought by plaintiff Jessica Ellen Legens and Regions Bank against tow truck driver Mark Ikerman, his employer, Mannheim Services Corporation, Mac & Mick's Sports Bar and the owners of Sparky's Pub 397 had been set for trial Jan. 10.
According to an order signed by Madison County Circuit Judge David Hylla on Jan. 5, the parties' settlement will be reset for an approval hearing.
The suit sought damages in excess of $50,000 a count and moves to add punitive damages were pending at that the time of the settlement.
Donald Legens Sr. and his son died in Granite City in November 2008.
The two were killed when a tow truck drive by Ikerman hit their stopped car.
The impact pushed the car into Donald Legens Sr. who was outside the vehicle which had run out of gas.
His son was inside the car. Donald Legens Sr. died on the night of the accident. His son died shortly after from his injuries.
The plaintiffs contended that Ikerman had been drinking at the two bars before the accident and that Mannheim was liable as his employer.
Ikerman faces criminal charges in connection with the accident.
Details of the settlement were not available in the Jan. 5 docket entry.
No hearing date on the settlement's approval is set as yet.

Troy Walton entered his appearance in the case Jan. 4 representing
Donald Legens Jr. and two non-parties to the suit, William Cordell Legens and Loretta Gene Legens as his next of kin.
