Route 111 accident is subject of suit

A St. Clair County woman claims she sustained serious injuries when a driver rear-ended her vehicle.

Shannon T. McFarland filed a lawsuit Dec. 10 in Madison County Circuit Court against Cheryl L. Haynes.

In her complaint, McFarland claims she drove her 2004 Chevrolet Cavalier north on Highway 111 near its intersection with Pontoon Road in Pontoon Beach on July 15, 2009, when Haynes, who drove in the same direction, failed to control her speed and rear-ended McFarland.

In addition to her injuries, McFarland became hindered and prevented from attending to her usual duties, experienced pain and anguish and incurred medical costs because of the collision, according to the complaint.

She blames Haynes for causing the accident, saying Haynes negligently failed to sound her horn, drove too fast, failed to keep her vehicle under proper control, failed to keep a proper lookout and failed to apply her brakes. In addition, Haynes failed to stop when danger appeared imminent, the suit states.

In her complaint, McFarland seeks a judgment of more than $50,000, plus costs.

Clay B. St. Clair of Crowder and Scroggins in Columbia will be representing her.

Madison County Circuit Court case number: 10-L-1237.
