Geoffrey J. Scott is suing the driver of a vehicle who allegedly caused a two-car crash that led to the death of Mindi Mae June Rogers.
Scott filed a lawsuit on Dec. 9 in Madison County Circuit Court against Meredith R. Middleton on behalf of the estate of Rogers.
Scott says Rogers was driving her 2002 Ford Explorer north on US 67 near CR750. She says Middleton was driving her 2008 Dodge Nitro south on the same road when she crossed the center lane and collided with Roger's vehicle, killing her.
Scott claims Middleton failed to reduce her speed, operate at a reasonable rate of speed or to steer in such a way as to avoid the collision. She also blames Middleton for failing to brake adequately or keep a proper lookout for other cars.
Scott is further seeking judgment against Middleton for the wrongful death of Rogers, which he says caused Roger's 5-year-old daughter Icess to suffer mental anguish and emotional pain as well as the loss of the support and services of her mother.
In his complaint, Scott seeks damages of $50,000 plus costs on both counts against Middleton.
Marc W. Parker of LakinChapman is representing him.
