Boy's hockey injury case in court

A case management conference is set in a father's suit against an insurance company he claims wrongfully refused to pay a claim resulting from his son's hockey injuries.

Plaintiff Edwards Schaeffer of Edwardsville filed suit against Time Insurance Company, doing business as Assurant Health in August.

In his suit, Schaeffer claims the company willfully refused to pay his son's shoulder injury claim although it was covered by his family's insurance policy.

The plaintiff alleges that although his policy with Assurant forbade coverage of conditions related to bone spurs, his son's injured shoulder happened at a hockey game and had nothing to do with the disqualified condition.

The suit seeks damages in excess of $57,000, attorney's fees and other relief for breach of contract.

Assurant has yet to enter an appearance or file an answer in the suit.

The case management conference is set for 9 a.m. on Dec. 14 before Madison County Circuit Judge David Hylla.

The case is Madison case number 10-L-650.
