Smart car driver sues over serious interstate injuries

A man has filed a lawsuit against a driver who he claims collided with him.

Kyle W. Lindemann claims he was driving a 2008 Smart car south on Interstate 255 about 434 feet west of Interstate 270 in Pontoon Beach on Dec. 8, 2008, at about 7:04 a.m. when defendant David A. Kopp, who was driving a 2005 Dodge Dakota north on Interstate 255, collided with him.

Because of the accident, Lindemann was seriously injured, experienced pain and suffering, incurred medical costs and lost wages, according to the complaint filed Dec. 6 in Madison County Circuit Court.

Kopp negligently failed to decrease his speed to avoid a collision, failed to keep a proper lookout, drove too fast, failed to maintain control of his vehicle to avoid a collision and failed to drive within his lane, the suit states.

In his complaint, Kopp is seeking a judgment of more than $50,000, plus costs.

He will be represented by William R. Hoffeditz of Newton.

Madison County Circuit Court case number: 10-L-1216.
