An Alton man is suing his deceased mother's insurance company after it allegedly refused to pay her life insurance benefits.
Dunte Killiebrew filed the complaint Nov. 29 against Fidelity and Guaranty Life Insurance Company in Madison County Circuit Court.
According to the lawsuit, Killiebrew's mother, Eleanor White, purchased a life insurance policy from Fidelity in April 2005. Killiebrew says his mother paid nearly $70 each month in premiums and fulfilled all agreed-upon conditions through June 2006, the month she passed away.
Killiebrew claims he tried to collect on the insurance policy but was denied by Fidelity which said White failed to disclose her true medical history.
Killiebrew is suing Fidelity for breach of contract for unreasonably failing to pay the claim. He is asking for more than $50,000 to compensate for the insurance benefits owed under his mother's policy along with court costs. He is also requesting an unspecified amount in statutory penalties.
