Case management conference set in suit over music teacher's relationship with teen

A case management conference is set in a suit brought against O'Fallon School District #203, its teachers union and a former high school band teacher the plaintiff claims had a sexual relationship with her teenage daughter.

The case is also on its way to the appellate court in Mount Vernon over a transfer order that Madison County Chief Judge Ann Callis denied in October.

Defendant O'Fallon School District #203 is seeking a stay in the case filed by plaintiff Jane Doe until it can appeal the transfer order.

The conference is set Dec. 15 at 9 a.m.

Jane Doe is suing O'Fallon, its teachers union and former music teacher Matthew Lang for damages in excess of $50,000 and other relief.

Jane Doe claims that her daughter, Mary Doe, suffered emotional and other harm after she and Lang had a sexual relationship while Lang was her music teacher in the Alton school district.

Jane Doe claims her daughter was not of legal age to consent to the relationship.

That district was part of the suit but was dropped from the case earlier this year.

Matthew Lang pleaded guilty to criminal charges in connection with the relationship earlier this year.

The plaintiff claims that the O'Fallon school district and the teachers union concealed evidence of Lang's previous inappropriate relationships with students when Alton officials came to them seeking information about Lang during their hiring process.

O'Fallon denies the claims.

The school district has sought to have the suit transferred to St. Clair County, arguing that the alleged transactions took place there and that it has a greater connection to the case.

Callis denied that move in October.

The school district moved Nov. 4 for the stay in the Madison County case in order to have time to appeal Callis' denial of the transfer.

Thomas Falb represents Jane Doe.

James Craney and others represent the O'Fallon school district.

Lang does not have representation listed in the civil suit.

The case is Madison case number 09-L-886.
