Crowder to hear plea to reconsider plaintiff's voluntary dismissal of accident suit

A plaintiff who voluntarily dropped a suit against the estate of a man who hit her car in Alton five years ago is asking to reinstate her case.

Madison County Circuit Judge Barbara Crowder is set to hear the plea on Dec. 10 at 9 a.m.

Plaintiff Sarah Monroe dropped her suit against Thomas Schmidt, the special administrator of the estate of Andrew Schmidt, in October.

Monroe originally filed suit in 2007, claiming that she was injured when Andrew Schmidt's car hit hers at an Alton intersection because Andrew Schmidt was speeding and under the influence of drugs and/or alcohol.

The plaintiff is seeking damages in excess of $50,000 and other relief.

She is suing on claims of negligence and negligent entrustment.

Amy Meyer represents Monroe.

Martin Morrissey represents Thomas Schmidt.

The case is Madison case number 07-L-501.
