Root canal was unnecessary and done poorly, suit claims

A Madison County couple is suing a Godfrey dentist for allegedly performing unnecessary dental work and doing it poorly.

Marc and Kathy Kirby filed the lawsuit against Anna Smith, D.M.D. and her employer, Dentistry With TLC, on Nov. 10 in Madison County Circuit Court.

According to the complaint, Kathy Kirby was a patient of Dr. Smith in the latter part of 2008. Kirby alleges Dr. Smith gave her an unnecessary root canal. Kirby also contends Dr. Smith didn't do a very good job on the root canal and that her condition worsened after the procedure. Kirby says she was forced to go to a different dentist to try to correct the problem.

Kirby and her husband are suing Dr. Smith and her employer for negligence. They seek an unspecified amount of money to cover lost wages, medical costs, loss of consortium and court fees.

The Kirbys are represented by attorney Donald M. Flack, of Wood River. They ask for a jury trial.

Madison County Circuit Court case no. 10-L-1148.
