Roofer's suit against employer over injuries set for trial Nov. 29

Madison County Circuit Judge Andreas Matoesian is set to open the trial of a roofer's personal injury suit following the Thanksgiving holiday.

The trial of the case brought by plaintiff Anthony Lovsey is set to start Nov. 29 at 9 a.m.

Lovsey is suing Rehkemper and Sons Inc. and Home Structures Inc. for damages in excess of $50,000 and costs.

Lovsey claims the defendants failed to provide him with a safe work environment.

The plaintiff claims that the failure led him to injure his back and leg and to suffer other injuries when he was knocked from the roof of a building he was working on in Edwardsville in December 2005.

Rehkemper filed a third party complaint in the suit against Home Structures in March 2009.

In that complaint, Rehkemper claims that it denies Lovsey's allegations.

However, it argues that if it is found liable for any damages in the suit, Home Structures must bear a commensurate percent of the fault and damages.

Earl Hubbs, one of Lovsey's attorneys move to withdraw from the case in May of this year.

Matoesian allowed that withdrawal in July.

Lovsey represents himself.

Rehkemper is represented by Michael Read.

Home Structures is represented by Catherine O'Connell.

The case is Madison case number 07-L-561.
