Collinsville's Splash City sued over woman's sidewalk injuries

A woman has filed suit against Collinsville Area Recreation District doing business as Splash City Family Waterpark, claiming she broke her hip after falling on a defective sidewalk.

Cecelia R. Weir claims she was visiting Splash City on June 23 when she fell on a defect in the walking surface.

"That the defect in the walking surface was located in front of or near the enclosed area where the Defendant kept and maintained various types of repair and maintenance equipment," the suit filed Nov. 9 in Madison County Circuit Court states.

"That a number of people slipped or tripped because of the defect before June 23, 2010. That the Defendant had actual knowledge for a significant amount of time before June 23, 2010, that a number of people had slipped or tripped because of the defect."

Because of her fall, Weir suffered a fractured left hip; experienced pain, suffering and disability; and lost her normal life, according to the complaint In addition, she suffered disfigurement and incurred medical costs, the suit states.

Splash City negligently failed to properly inspect walking areas, failed to properly maintain walking areas, failed to properly repair walking areas and failed to warn of a defect in walking areas, the complaint says.

In her two-count complaint, Weir is seeking more than $100,000, plus costs.

She will be represented by Edward J. Szewczyk of Callis, Papa, Hale, Szewczyk and Danzinger in Granite City.
