Amputee's suit against St. Joseph's Hospital dismissed

Callis

A suit over the amputation of a man's leg at St. Joseph's Hospital in Highland is over.

Madison County Chief Judge Ann Callis signed the order dismissing the suit brought by Fred and Robeye Walker with prejudice Nov. 4.

The Walkers had filed suit against the hospital, Dr. Anthony Sodd and Mid-America Radiology seeking damages in excess of $50,000.

Robeye Walker had filed for a claim of loss of consortium.

The Walkers claimed that mistakes in diagnosing a cyst in Fred Walker's left leg led to its eventual amputation in 2008.

A trial that had been scheduled for September was called off.

Stipulation for dismissal filed by the parties does not indicate a settlement amount.

Each party is to bear its own costs.

Kevin Sullivan and Thomas Keefe Jr. represented the Walkers.

Michael Nester represented the hospital.

Ted Dennis represented Sodd and his practice.

The case is Madison case number 08-L-795.
