St. Louis Convention and Visitors Commission moves to throw out 'Holiday Magic' suit

The St. Louis Convention and Visitors Commission (SLCVC) is asking that a Madison County breach of contract suit filed by Edwardsville-based Experiencing Imagination Companies be thrown out for lack of jurisdiction.

SLCVC filed its motion to dismiss the suit Nov. 5, although a copy of that filing is not yet in the suit's case file.

The motion is set for hearing before Circuit Judge David Hylla Friday at 9:30 a.m.

Experiencing Imagination is suing the St. Louis commission for allegedly failing to pay the company cancellation fees after it ended the plaintiff's contract to provide event services and materials for the commission's "Holiday Magic" events through 2011.

SLCVC claims that the Madison County court lacks jurisdiction over it, according to an entry in the case's docket sheet.

The plaintiff is seeking damages of $135,163 the company claims to be owed, costs and attorney's fees.

Steven Erickson represents SLCVC.

The case is Madison case number 10-L-688.
