Bunkum Road accident is subject of suit

A man has filed suit against the driver who he claims struck his vehicle.

Edmond Gregory Stoltz claims he was driving his 2002 Chevrolet Cavalier west on Bunkum Road when he attempted to make a left turn at a stoplight.

At the same time, defendant Joann Galan was driving her 2005 Chevrolet Malibu north on Illinois Route 157 approaching the same intersection when the accident occurred, according to the complaint filed Oct. 1 in St. Clair County Circuit Court.

"Plaintiff Edmond Gregory Stoltz entered the intersection of Illinois Route 157 and Bunkum Road after the traffic light turned to green," the suit states. "At the same time, the Defendant Joann Galan operated her vehicle through the red light striking the Plaintiff Edmond Gregory Stoltz's vehicle on the driver's side with the front of Defendant Joann Galan's vehicle."

Because of the collision, Stoltz sustained injury to his right leg, left hand, left chest and back and fractured his right ankle, the complaint says. In addition, he incurred medical costs, lost wages, experienced pain and suffering and suffered from a diminished quality of life, he claims.

In his complaint, Stoltz blames Galan for causing the accident, saying she negligently failed to yield the right-of-way to him, failed to keep a proper lookout for traffic, failed to obey the traffic signal and failed to exercise ordinary care.

In his complaint, Stoltz is seeking a judgment of more than $50,000, plus costs.

John H. Leskera of Leskra Law Firm in Collinsville will be representing her.

St. Clair County Circuit Court case number: 10-L-514.
