O'Fallon couple sues Thoman Insurance over failure to cover lawsuit costs

Two St. Clair County residents claim their insurance carrier refuses to cover them in a lawsuit filed against them despite the fact that they should have had liability insurance through the company.

Jeffrey and Lisa Hangsleben filed a lawsuit Oct. 4 in St. Clair County Circuit Court against Thoman Insurance Agency.

The Hangslebens claim they purchased an insurance policy, which should have included liability coverage, through defendant Thoman Insurance Agency.

On Oct. 5, 2008, an accident occurred outside the Hangslebens' home at 1072 Vincennes Trail in O'Fallon, according to the complaint.

After the Hangslebens were named as a defendants in a lawsuit filed in relation to the accident, they discovered they were not insured, the suit states.

They blame Thoman for negligently failing to list them as insureds on the policy and for failing to procure the proper coverage they requested, the complaint says.

In their two-count complaint, the Hangslebens seek a judgment of more than $100,000, plus costs.
