Two Cottage Hills women claim severe injuries after being struck on foot by a vehicle driven by Brittany D. Daniels near the Schnuck's parking lot in Bethalto.
Deneen M. Philbeck and Shannon L. Philbeck filed a lawsuit Sept. 30 in Madison County Circuit Court on against Daniels.
The two were walking East across North Bellwood about 7 p.m. on Sept. 23, 2009 when Daniel's car collided with them. The Philbeck's suit claims theat Daniels was entering North Bellwood after exiting the Bethalto Schnuck's parking lot.
They claim Daniels was negligent in failing to reduce her speed, control her car and lookout properly for pedestrians.
Deneen Philbeck suffered an injured left foot and elbow. She claims the injuries prevent her from attending to her usual duties and have left her liable for medical costs and hospitalization.
She says she has incurred lost wages. In her complaint, she is seeking $50,000 plus costs.
Shannon Philbeck says she suffered a crushed and displaced right knee in the same collision. She says she has also incurred lost wages and medical and hospitalization costs.
In the second count of the suit, she is seeking a judgment of $50,000 plus costs.
