A St. Clair County woman has filed suit against the village of Cahokia, alleging she suffered property damage after sewage backed up into her home.
Dorothy B. Matejka claims she lived at 35 School Street in Cahokia when the village's sewer system failed on June 4 and backed onto her property.
In addition to property damages, Matejka suffered the loss and quiet enjoyment of her premises, according to the complaint filed Aug. 24 in St. Clair County Circuit Court.
Cahokia negligently failed to properly inspect the sanitary sewer system, failed to keep the sanitary sewer system in proper order, failed to properly maintain the sewer system and failed to keep the sewer system free from obstructions, the suit states. In addition, the village failed to promptly repair the sewer system and failed to place backflow preventers in the system, the complaint says.
In her complaint, Matejka is seeking a judgment of more than $100,000, plus costs.
B. Jay Downing of the Law Offices of Sterling and Dowling in Fairview Heights will be representing her.
