A woman has filed suit against the driver who she claims rear-ended a vehicle while she was riding in its back seat.
Shirley McDonald claims she was riding in a vehicle traveling west on Route 50 and Old Collinsville Road in Caseyville on Nov. 25, 2008, at about 1 p.m. when defendant Leovamae F. Pelc, who was driving a vehicle for her employer -- defendant Lee Maids -- in the same direction, rear-ended the vehicle.
Because of the collision, McDonald was made sick, sore, lame, disordered and disabled; and suffered extensive injuries to her head, body, limbs, neck, shoulders and low back, according to the complaint filed Aug. 19 in St. Clair County Circuit Court. In addition, she incurred medical costs, experienced pain and suffering and lost wages, the suit states.
Pelc negligenly failed to keep a proper lookout, drove in such a way that she struck McDonald's vehicle, failed to properly apply her brakes, drove too fast, followed the vehicle in which McDonald was riding too closely and drove without adequate brakes, the complaint says.
In her two-count complaint, McDonald is seeking a judgment of more than $100,000, plus costs.
John H. Hustava of Collinsville will be representing her.
