A rear-end accident case that was set for trial later this month in Madison County is over.
According to the case's docket sheet, defense attorney John Cunningham notified the court Aug. 31 that the case against his client, Albin Rak III, had settled.
Details of the settlement with plaintiff Christopher Rowe are not yet available.
Rowe sued Rak III a year ago for damages in excess of $50,000 and costs.
Rowe claimed that Rak III rear-ended him and injured him in October 2007.
Rak III initially denied liability in the accident but later changed his answer in the case, admitting fault.
Madison County Chief Judge Ann Callis presides.
Rowe is represented by Phillip Rice.
The case is Madison case number 09-L-269.
