I-55/70 Maryville accident is subject of suit

A woman claims she sustained neck, back, left foot and shoulder injuries during a collision with a driver who failed to stay on the highway.

Dorothy Graves filed a lawsuit Aug. 19 in Madison County Circuit Court against Krystal M. Henderson.

Graves claims she rode in a vehicle traveling west on Interstate 55/70 on Dec. 23, 2008, at about 7:30 a.m. in Maryville when the collision with Henderson occurred.

"The defendant, Krystal M. Henderson, failed to keep her motor vehicle in her lane of traffic, causing it to leave the highway, hitting the dividing cables and back into the highway, causing a collision to occur and injury to the plaintiff, Dorothy Graves," the suit states.

Because of the collision, Graves became sick, sore, lame, disordered and disabled and incurred medical costs. In addition, she suffered disability, experienced pain and suffering, lost wages and suffered an impaired earning capacity, the complaint says.

Graves blames Henderson for failing to keep a proper lookout, for driving in such a manner as to cause a collision, for failing to properly apply her brakes, for driving too fast, for failing to reduce her speed and for failing to stay in one-half of the road.
In her complaint, Graves seeks a judgment of more than $50,000, plus costs.
