Norfolk Southern blamed for worker's injuries

A former railroad worker has filed suit against Norfolk Southern Railway, alleging he developed numerous injuries because of the nature of his employment.

Timothy L. Neal claims he experienced numerous repetitive traumas while he worked as a machine operator from 1972 until 2008.

Neal's work for the railroad caused him to sustain severe and permanent injuries to his wrists, elbows and body; and to suffer great pain and mental anguish, according to his complaint filed Aug. 17 in Madison County Circuit Court. In addition, he lost earnings, experienced a diminished earning capacity and incurred medical costs, the suit states.

Norfolk Southern negligently failed to provide safe tools and equipment, failed to provide proper supervision, failed to warn of a hazardous condition, allowed unsafe practices to become standard, assigned Neal work it knew would result in injury and assigned Neal duties it knew were beyond his physical capacity, the complaint says.

In his suit, Neal is seeking a judgment of more than $50,000, plus costs.
