A woman has filed suit against the driver who she claims failed to yield the right-of-way to her and caused a collision.
Delores L. Ballard-Enlow claims she was driving north on Illinois Route 159 near its intersection with Malinda in Fairview Heights on Nov. 5, 2009, when defendant Brittany R. Stanczyk, who was driving from a parking lot of a Moto Mart, entered into Ballard-Enlow's lane of traffic and hit her.
Because of the accident, Ballard-Enlow sustained injuries and suffered pain, permanent disability and disfigurement, according to the complaint filed Aug. 11 in St. Clair County Circuit Court. She also incurred medical costs and lost wages, the suit states.
Stanczyk negligently failed to drive within a single lane of traffic, failed to keep a proper lookout, failed to yield the right-of-way and failed to stop or swerve to avoid a collision, the complaint says.
In her complaint, Ballard-Enlow is seeking a judgment of more than $15,000, plus costs.
