A man who has already been awarded $20,000 in a claim following a car collision seeks additional money from his insurance company in a recently filed suit.
Cory Bishop filed a lawsuit Aug. 5 in St. Clair County Circuit Court against Allstate Fire and Casualty Insurance Company.
Bishop claims he and Leon Hampton collided when Hampton struck the rear of his vehicle as Bishop drove south on Interstate 55 on Oct. 18, 2008.
Because of the collision, Bishop suffered injuries to his neck, back and chest and incurred medical bills of more than $10,000, according to the complaint.
Following the accident and with permission from his insurance company, Allstate, Bishop settled a claim against Hampton for his $20,000 insurance limits, the suit states.
However, with his medical bills and lost wages, Bishop's loss from the accident exceeded $20,000, the complaint says.
Now, Bishop wants to collect money from Allstate under the terms of his underinsured motorist provision, but Allstate refuses to pay him, he claims.
In his complaint, Bishop seeks a judgment of more than $50,000, plus attorney's fees, costs, interest and other relief the court deems just.
