Passenger in Omphghent Township accident sues

A woman has filed suit against the driver who she claims struck the left side of the vehicle in which she was riding.

Leisha D. Talley claims she was riding in a vehicle George A. Talley was driving east on Renken Road in Omphghent Township in Madison County on Aug. 15, 2008, when the collision occurred. George A. Talley attempted to make a left-hand turn near Renken Road's intersection with Prairietown Road when defendant Alex L. Radae attempted to pass his vehicle, but struck its left side while in the process, according to the complaint filed July 28 in Madison County Circuit Court.

Leisha D. Talley claims that because of the collision, she sustained serious and permanent injuries; experienced pain, suffering and disability; and incurred medical costs.

Radae negligently drove in an improper and careless manner, drove too fast, disregarded traffic signals, failed to maintain a proper lookout, failed to keep his vehicle under proper control, failed to keep the steering wheel and brakes of his vehicle in proper order and failed to brake to avoid a collision, among a number of other negligent acts, the suit states.

In her complaint, Leisha Talley is seeking a judgment of more than $50,000, plus costs.
