A man has filed suit against the driver who he claims failed to yield the right-of-way at an intersection, causing a collision.
Wendell Johnson claims he was driving a 2006 Ford F Series 4x2 west on East U.S. Highway 50 near its intersection with Lakepointe Centre Drive in O'Fallon on Aug. 5, 2008, when defendant Arthur D. Knecht, who was driving a 2004 Dodge Neon east on the same road, struck him.
Because of the collision, Johnson suffered severe and permanent injuries, was hindered and prevented from attending to his usual duties and suffered great pain and anguish, according to the complaint filed July 26 in St. Clair County Circuit Court.
Knecht negligently failed to stop or swerve to avoid a collision, drove without sufficient control, drove too fast, drove without keeping an adequate lookout and failed to equip his vehicle with adequate brakes, the suit states. In addition, Knecht failed to stop or yield the right-of-way at an intersection, the complaint says.
In his suit, Johnson is seeking a judgment of more than $50,000, plus costs.
