Worker claims Support Systems wrongfully discharged him

Scoggins

An Alorton man claims his employer wrongly terminated him after he sustained work-related tailbone and back injuries.

Derrick Henry filed a lawsuit July 28 in St. Clair County Circuit Court against Support Systems and Services.

Henry claims he sustained his injuries on Aug. 28 and subsequently exercised his rights under the Workers' Compensation Act.

According to the complaint, Henry again sustained injuries on Jan. 17 to his left hand and small finger and again applied for workers' compensation benefits.

However, in retaliation for Henry's workers' compensation claims, Support terminated him, a violation of the Workers' Compensation Act, the suit states.

In his complaint, Henry seeks compensatory damages of more than $50,000, plus punitive and exemplary damages, costs and other relief the court deems just.

Mark C. Scoggins, Clay B. St. Clair and Anthony P. Gilbreth of Crowder and Scoggins in Columbia will be representing him.

St. Clair County Circuit Court case number: 10-L-389.
