GE claims trucking company breached contract

General Electric has filed suit against a trucking company and its owners after it says the company reneged on a promise to buy more than $150,000 worth of trucks and equipment.

General Electric Capital Corporation claims it entered into a truck lease agreement with defendant Zimmerman Trucking in which it agreed to provide the company with trucks and equipment. Co-defendants Garland and Donna J. Zimmerman signed a guaranty, promising to pay for the materials, the suit states.

Since then, however, the defendants have failed to make monthly payments and owe General Electric $158,016.28, according to the complaint filed July 21 in Madison County Circuit Court.

In addition to the money it says it is owed, General Electric is seeking interest at 18 percent per annum, attorneys' fees of $1,450, costs and other relief the court deems just.

It will be represented by C. Raymond Bell of Foley and Mansfield in St. Louis.

Madison County Circuit Court case number: 10-L-760.
