Frank Scott Parkway accident causes injuries, suit says

Two people have filed suit against the driver who they claim caused them to sustain neck, shoulder and low back injuries after rear-ending their vehicle.

Travis M. Morthland claims he was driving north on Sullivan Drive near its intersection with Frank Scott Parkway in Fairview Heights on Feb. 14 when defendant Heather L. Wise, who was driving in the same direction, struck the rear of his vehicle. At the time of the collision, co-plaintiff Amber D. Morthland was riding in the vehicle, according to the complaint filed July 16 in St. Clair County Circuit Court.

In addition to their injuries, the Morthlands were made sick, sore, lame, disordered and disabled and incurred medical costs, the suit states. They also sustained disability, experienced pain and suffering and lost wages, the complaint says.

They blame Wise for causing the accident, saying she failed to keep a proper lookout, struck the rear of their vehicle, failed to properly apply her brakes, drove too fast, drove too closely to their vehicle and failed to decrease her speed due to weather conditions.

In their two-count complaint, the Morthlands are seeking a judgment of more than $100,000, plus costs.

They will be represented by Thomas C. Rich and Kristina D. Cooksey of Fairview Heights.

St. Clair County Circuit Court case number: 10-L-364.
