A postal worker and his wife have filed suit against the owners and occupants of a Hartford home where they say a stairway lacked a railing next to it, causing the mailman to fall.
Christopher Campbell and Rachel Campbell claim Christopher Campbell attempted to deliver mail to a home at 210 S. Delmar Ave. on July 1, 2008, when the incident occurred. At the time, defendant Jerry Conley and Star Jestis resided at the house and defendants Jerry L. Eller and W. Arlene Conley owned the premises, according to the complaint filed June 30 in Madison County Circuit Court.
Because of his fall, Christopher Campbell incurred medical costs, experienced pain and suffering and lost wages, the suit states. In addition, Rachel Campbell lost her husband's society, consortium, companionship, love, affection and support, the complaint says.
The Campbells allege negligence against the defendants, saying they breached their duty to remove or warn of a dangerous condition.
In their three-count complaint, the Campbells are seeking a judgment of more than $150,000, plus pre- and post-judgment interest, costs and other relief the court deems just.
