A trial set next Monday in a 2008 car accident case has been continued to September as the parties appear close to settling their claims.
Plaintiffs Maurice and Maxine Duncan filed suit against Julie Ewell claiming that they were injured when Ewell hit their car at an intersection in Bethalto in November 2007.
According to their complaint, Ewell failed to yield the right of way in the intersection and to reduce her speed.
The suit seeks damages in excess of $50,000 and costs.
The plaintiffs asked to continue the July 19 trial due to ongoing settlement negotiations.
According to the filing, the claims have been settled "in principle."
Madison County Circuit Judge Dennis Ruth granted the move last week.
The new trial date is set for September.
The case had previously been assigned to former Madison County Circuit Judge Nicholas Byron.
The Duncans are represented by Richard Reed.
Ewell is represented by Paul Travous.
The case is Madison case number 08-L-1090.
