Driver failed to stay on right side of the road, suit claims

A driver who failed to stay on the right side of the street caused a woman to sustain serious injuries, according to a recently filed complaint.

Cynthia A. Haps and Gary L. Haps filed a lawsuit May 19 in St. Clair County Circuit Court against Robert L. Schmid.

The Haps claim Gary Haps drove a 2007 Pontiac Grand Prix west on Illinois Route 177 near its intersection with Belle Valley Drive in Belleville on May 30, 2008, at about 5:24 p.m. when Schmid, who drove a 1999 Cadillac Deville east on the same road, struck the Grand Prix. At the time of the collision, Cynthia Haps rode as a passenger in the Grand Prix.

Because of the accident, the Haps suffered serious, severe and permanent injuries; experienced mental pain and anguish; incurred medical costs; lost wages; and sustained a diminished earning capacity, according to the complaint.

The Haps blame Schmid for causing the collision, saying he failed to keep his vehicle under proper control, failed to keep a proper lookout for other vehicles, failed to stop or avoid a collision, drove without safe brakes, drove in the left half of the street and failed to yield the right-of-way.

In their two-count complaint, the Haps seek a judgment of more than $100,000, plus costs.
