Scott Troy Road accident is subject of suit

A Madison County woman has filed suit against the driver who she claims struck her vehicle after an attempt to avoid a collision with another vehicle.

Amanda M. Wood claims she was driving north on Scott Troy Road near West Mill Creek Road and was attempting to turn left onto West Mill Creek Road on May 4.

According to the complaint filed June 3 in Madison County Circuit Court, defendant Shelby N. Busche was driving her vehicle behind Wood and a third vehicle was between Wood's vehicle and Busche's. Suddenly, Busche pulled her vehicle into the left lane to avoid colliding with the vehicle behind Wood and slammed into Busche's vehicle instead, the suit states.

Because of the accident, Wood sustained severe and permanent injuries; experienced pain, suffering and disfigurement; and incurred substantial medical bills, the complaint says. In addition, she claims she lost wages and endured an impaired earning capacity, was forced to obtain a rental vehicle and was set back in her career endeavors.

Busche negligently failed to keep a proper lookout, drove in a reckless manner, drove too fast, drove her vehicle into oncoming traffic rather than the right shoulder, failed to drive on one half of the road, failed to drive within a single lane, failed to sound her horn, failed to reduce her speed to avoid a collision, followed Busche's vehicle too closely, attempted to pass at an intersection and attempted to pass in a no passing zone, according to the complaint.

In her complaint, Wood seeks a judgment of more than $50,000, plus costs.

Brian M. Wendler of Wendler Law in Edwardsville will be representing her.

Madison County Circuit Court case number: 10-L-582.
