Woman's injury suit after car stopped without parking settles

A negligence suit stemming from a car that rolled after its driver allegedly failed to put it in park after stopping has settled.

It had been set for trial Monday before Madison County Circuit Judge Andreas Matoesian.

Plaintiff Lossie Bauer sought damages in excess of $50,000 and costs from defendant Keith Bauer.

It is unclear from the case file what if any relation the two Bauers are to one another.

According to her complaint, Lossie Bauer was a passenger in Keith Bauer's vehicle when he stopped at a Collinsville home.

Keith Bauer allegedly failed to put his car in park when he stopped and exited the vehicle.

Lossie Bauer was still inside it when it rolled. She claims the rolling vehicle caused an accident.

She alleges that due to Keith Bauer's negligence she fractured her ankle and injured her knee, foot and suffered a bruised chest causing chronic pulmonary obstructive disease (COPD).

The case settled April 26 and stipulations are to be filed, according to the April 26 order signed by Matoesian.

Lossie Bauer is represented by Mark Levy.

Keith Bauer is represented by Kevin Babb.

The case is Madison case number 09-L-119.
