Raging Rivers settles injury suit for $30,000

A local water park has settled with a boy and his mother who claim the boy hurt his mouth and teeth at the park nearly four years ago.

Plaintiffs Gage Kerr and his mother, Wendy Kerr have settled their claims against Raging Rivers Water Park Inc. of Grafton and its insurance company for $30,000.

There is no mention in the defense motion for finding of good faith settlement what, if anything, the Kerrs' attorneys receive from the settlement.

That leaves two defendants in the Kerrs' suit, H. Adams Development Co. and E.W. Development.

Defendant Vaughn Pools Inc. settled with the plaintiffs last year.

Wendy Kerr sued on behalf of herself and son Gage, over allegations that Gage hurt his mouth and teeth on the Space Bowl ride at Raging Rivers in 2006.

Vaughn Pools settled for $7,500. About $2,500 of that went to plaintiffs' attorney Thomas Maag.

Raging Rivers is represented by James Craney and others.

No attorney is listed for EW Development, a company based in the United Kingdom.

No attorney is listed for H Adams Development.

James Drazen is listed as attorney for Gage Kerr as a minor.

Madison County Circuit Judge Barbara Crowder presides.

The case is Madison case number 08-L-521.
