A pedestrian claims an intoxicated driver stopped his vehicle, exited it and punched the pedestrian in the head out of the blue.
Chrisotpher Foote filed a lawsuit April 6 in Madison County Circuit Court against Justin Lee Baker, Drift Inn and Ardie and Tiny's.
Foote claims he attempted to cross St. Louis Road in Collinsville on Jan. 1 when Baker, who drove on the same road, stopped his vehicle, exited it and punched Foote in the head without provocation.
According to the complaint, Baker had been served alcoholic beverages at Drift Inn and Ardie and Tiny's directly before the incident, causing his intoxication and violent nature.
Because of Baker's actions, Foote suffered a closed head injury necessitating his transportation by helicopter from Anderson Hospital to St. Louis University, incurred medical costs, experienced post-traumatic stress and lost wages, the suit states. In addition, Foote's quality of life has diminished, the complaint says.
In his three-count suit, Foote seeks a judgment of more than $167,304.66.
