A woman has filed suit against Rosewood Care Center of Alton, Michael Brady, Bravo Nursing Home Services and Midwest Administrative Services, alleging she sustained a fractured femur while living at the nursing home.
Kathryn Meininger claims she was living at Rosewood Care Center of Alton -- which is owned by defendants Brady, Bravo and Midwest -- in July 2009 when she fell, causing her to sustain a fractured femur and to develop an infection.
Because of her fall, Meininger incurred medical costs, endured substantial pain and suffering of her body and mind, can no longer achieve her goal to return home, suffered an aggravation to her pre-existing conditions and sustained disability and disfigurement, according to the complaint filed March 19 in Madison County Circuit Court.
The defendants breached their duty to prevent patients from experiencing physical harm by negligently failing to provide Meininger with appropriate nursing and medical care, by failing to provide adequate training of its employees, by failing to assure the facility adequately monitored Meininger, by failing to provide sufficient nursing staff for Meininger, by failing to assure adequate supervision of its employees, by failing to implement safety precautions to prevent Meininger from falling and by failing to secure a sufficient individualized care plan for Meininger, among a number of other negligent acts, the suit states. Bravo allocated excessive funds for itself, preventing the facility from running as it should have, the complaint says.
In her six-count complaint, Meininger is seeking compensatory and punitive damages of more than $300,000 and double damages for medical costs, plus attorneys' fees, costs and other relief the court deems just.
