Assault case against Godfrey car dealer dismissed

An assault case brought against a Godfrey car dealer by a woman who claimed he refused to let her out of his office and showed her pornography is over.

Madison County Circuit Judge Dennis Ruth signed an order March 24 dismissing plaintiff Brittany Gresham's suit against Brian Trust and Trust Family Auto Sales, Inc.

The parties agreed to the dismissal with prejudice, according to the order. The defendants had moved for the suit's dismissal earlier in March.

The order does not provide further details.

Gresham sued Trust and the car dealership alleging that when she
went to buy a car at Trust's dealership, he showed her pornography, made lewd comments and masturbated in front of her while refusing to let her leave his office.

In hearings, defense attorney Ryan Mahoney said Trust had been convicted of indecent exposure in the incident although he maintained it was consensual.

Gresham's suit sought damages in excess of $50,000.

During one hearing, Ruth admonished Gresham's attorney, Thomas Maag, over his use of a common term for a sex act.

In addition to dismissing Gresham's suit, Ruth's order requires the Circuit Clerk's Office to close the file unless further directed by the Court.

The March 24 order also moots any pending motions or status conferences in the suit.

The case is Madison case number 09-L-268.
