Helmkamp Construction sues over unpaid labor and materials

A construction company has filed suit against an Ohio and an Illinois corporation, claiming they failed to pay for labor and materials the construction company provided.

Helmkamp Construction Company claims it entered into a subcontract with defendant Ohio corporation NBW on Nov. 13, 2009, to provide it with labor, materials and supplies for improvements to property at 1951 State St. in Granite City, which was owned by defendant Illinois corporation US Steel.

After completing the work per the contract, Helmkamp asked NBW for payment of $107,122.17, but NBW refused to reimburse the construction company, according to the complaint filed March 11 in Madison County Circuit Court.

After failing to receive payment by Jan. 19, Helmkamp filed a mechanic's lien against NBW and US Steel, the suit states.

In the three-count suit, Helmkamp is seeking the money it says it is owed, plus interest at 10 percent until the money is paid, attorneys' fees, costs and other relief the court deems just. In addition, it is seeking a special judgment and decree of mechanic's lien against the State Street property.
