Strolling pedestrian sues Lerch Homes over sidewalk trip

A pedestrian blames a corporation for causing her to sustain injuries to her head, back and body after she tripped over a hose.

Linda Perko filed a lawsuit Feb. 24 in Madison County Circuit Court against Lerch Homes.

Perko claims she strolled east on the sidewalk at West Main and Williams Street in Maryville on Nov. 3, 2009, when she tripped over a hose placed on the sidewalk by Lerch Homes.

In addition to her injuries, Perko sustained great pain and mental anguish, lost large sums of money because of her inability to pursue a normal occupation and incurred medical costs because of the fall, according to the complaint.

She blames Lerch Homes for causing her fall, saying it placed a hose on the sidewalk where it knew the hose created a dangerous condition for pedestrians and failed to warn pedestrians of the hose's presence.

Perko seeks a judgment of more than $50,000, plus costs.

Matthew A. Marrison of Cook, Ysursa, Bartholomew, Brauer and Shevlin in Belleville will be representing her.

Madison County Circuit Court case number: 10-L-202.
