An accident suit stemming from a 2006 Glen Carbon car accident is set for trial in Madison County on Monday.
Plaintiff Joshua Miller is suing Joseph Mondorf for damages in excess of $50,000.
The case had been set for trial in November 2009 but was continued.
Madison County Circuit Judge Andy Matoesian is presiding.
According to Miller's suit, Mondorf hit his car while both were driving north on Illinois State Route 159 near Edwards Drive in Glen Carbon.
Miller claims Mondorf failed to control his car, failed to sound warning and was driving too fast when the accident happened.
Mondorf denies the allegations in his answer.
The trial is set to begin at 9 a.m.
Miller is represented by Michael Bilbrey of Edwardsville.
Mondorf is represented by John Leskera of Collinsville.
The case is Madison case number 08-L174.
